Re:   Formal Demand for [FULL REFUND / REPLACEMENT / REPAIR AND COMPENSATION] — Defective [PRODUCT NAME / SERVICE DESCRIPTION]

Order/Invoice No.: [ORDER NUMBER / INVOICE NUMBER / RECEIPT NUMBER]

Amount at Issue: $[TOTAL AMOUNT PAID]

Dear [RECIPIENT NAME / "Sir or Madam" / "To Whom It May Concern"]:

I am writing to formally demand [A FULL REFUND OF $______ / A REPLACEMENT OF THE DEFECTIVE PRODUCT / A COMPLETE REPAIR PLUS COMPENSATION OF $______] for the defective [PRODUCT NAME AND MODEL NUMBER] that I purchased from [BUSINESS NAME]. Despite multiple good-faith attempts to resolve this matter, your company has failed to provide an adequate remedy. This letter constitutes a formal demand and serves as notice that I intend to pursue all available legal remedies if this matter is not resolved within the deadline stated below.

1. Purchase Details

On [DATE OF PURCHASE], I purchased the following from [BUSINESS NAME] at [STORE LOCATION / WEBSITE URL]:

A copy of the receipt/invoice is attached as Exhibit A.

2. Description of Defect / Service Failure

On or about [DATE DEFECT WAS DISCOVERED], I discovered that the [PRODUCT / SERVICE] is defective and fails to perform as advertised, warranted, and reasonably expected. Specifically:

[IF SERVICE FAILURE: Describe the service that was promised, how it was performed deficiently, and how the result differs from what was agreed upon or reasonably expected.]

The [PRODUCT/SERVICE] does not conform to the representations made at the time of sale, including [SPECIFIC CLAIMS MADE BY THE SELLER — e.g., "the product was advertised as waterproof," "the salesperson stated it would last 5+ years," "the website description stated it was compatible with..."]. Photographs and/or video documentation of the defect are attached as Exhibit B.

3. Prior Attempts to Resolve

I have made multiple good-faith efforts to resolve this matter directly with your company, all of which have been unsuccessful or inadequate:

Copies of all correspondence, call logs, emails, chat transcripts, and return receipts related to these attempts are attached as Exhibit C.

4. Warranty Terms and Breach [Include this section if the product came with a warranty. Delete if not applicable.]

The [PRODUCT NAME] was sold with a [FULL / LIMITED] warranty, a copy of which is attached as Exhibit D. The warranty states, in relevant part:

"[QUOTE THE SPECIFIC WARRANTY LANGUAGE THAT IS RELEVANT TO YOUR CLAIM — e.g., "This product is warranted against defects in materials and workmanship for a period of [X] years from the date of original purchase. If a defect is found, the manufacturer will, at its option, repair or replace the product at no charge."]"

The defect described above falls squarely within the scope of this warranty. [DESCRIBE HOW: e.g., "The product failed within the warranty period, the defect is in materials/workmanship as covered by the warranty terms, and I have complied with all warranty conditions including registering the product and using it in accordance with the provided instructions."]

Despite this, your company has [refused to honor the warranty / failed to respond to my warranty claim / offered only an inadequate partial credit of $_____ / required me to pay $_____ for a repair that should be covered / other]. This constitutes a breach of the express warranty.

5. Applicable Law

Your company's conduct violates several federal and state consumer protection statutes, including but not limited to:

Federal Law:

Arizona State Law: [Include if the transaction occurred in Arizona or if either party is located in Arizona. Modify or replace with your own state's consumer protection statute if applicable.]

[OPTIONAL — Include additional state-specific laws as applicable:]

6. Damages and Demand

As a direct and proximate result of your company's sale of a defective [PRODUCT/SERVICE] and subsequent failure to provide an adequate remedy, I have incurred the following damages:

Total Demand: $[TOTAL AMOUNT]

I hereby demand that [BUSINESS NAME] provide the following within the deadline stated below:

[Select one or more of the following demands and delete the rest:]

7. Deadline for Response

I demand a substantive written response and full resolution of this matter within [14 / 21 / 30] calendar days of your receipt of this letter, no later than [DEADLINE DATE].

A "substantive response" means either (a) full compliance with the demand stated above, or (b) a written counteroffer with a specific dollar amount and timeline. A form letter, a denial without explanation, or a failure to respond will be treated as a refusal to resolve this matter.

8. Consequences of Non-Compliance

If I do not receive a satisfactory response and resolution by the deadline stated above, I intend to exercise all available remedies, including but not limited to the following:

I strongly prefer to resolve this matter amicably and without litigation. However, I am prepared to take all necessary steps to protect my rights as a consumer if you do not act promptly and in good faith.

9. Preservation of Rights

Nothing in this letter shall be construed as a waiver of any rights, claims, or remedies I may have under federal, state, or local law, all of which are expressly reserved. This letter is written without prejudice to any and all claims I may assert in any legal proceeding.

Please direct all responses to me at the address listed above, or by email at [YOUR EMAIL ADDRESS]. I expect written confirmation of your resolution plan by [DEADLINE DATE].

Sincerely,

Instructions for Using This Template

  1. Replace all [BRACKETED PLACEHOLDERS] with your actual information. Delete any sections that do not apply to your situation (e.g., remove the Warranty section if no warranty was given).
  2. Gather your evidence first. Collect receipts, warranty documents, photographs of the defect, emails, chat transcripts, and records of phone calls before writing the letter.
  3. Keep the tone professional and factual. Avoid emotional language, threats, or personal attacks. Courts and regulatory agencies respond to facts, dates, and dollar amounts.
  4. Print on quality paper. Use standard 8.5" x 11" white paper. A typed, professional-looking letter carries more weight than a handwritten note.
  5. Send via Certified Mail with Return Receipt Requested. This creates proof of delivery. Keep the green return receipt card when it comes back to you. You can also send a courtesy copy by email.
  6. Keep copies of everything. Make at least two copies of the signed letter and all enclosures before mailing. Store one copy in a safe place.
  7. Set a reasonable deadline. 14 days is standard for straightforward refund demands. 21-30 days is appropriate for more complex matters or when dealing with large corporations.
  8. Follow through. If you do not receive a response by the deadline, follow through on the stated consequences. Empty threats undermine future efforts.
  9. Consider professional help. If your claim exceeds $3,500 (Arizona small claims limit) or involves complex legal issues, consider hiring an attorney or contacting DemandLetterService.com for professional preparation.
